Avoiding common mistakes with divorce

Many California couples whose marriages are coming to an end find themselves confronting the divorce legal process for the first time. Even those on their second or third time through divorce court may overlook some important facts and details that could have major effects on their case. It may be helpful to review some of the most common mistakes that many people make while going through a divorce.

It is important to assemble all germane information before the process begins, paying special attention to financial information. As the divorce goes on facts may change and the other party may become less forthcoming with necessary data, so putting together everything that will be needed at the beginning is a good idea. Careful attention to detail will be necessary at all stages, and any legally binding documents should be carefully reviewed by both spouses and their respective attorneys.

Experts on the issue agree that a more conciliatory approach to divorce and dividing marital property can be wise. It is best to not take an adversarial tone from the beginning, as that has a tendency to lead to bad feelings and high lawyer fees. It is also important to remember that divorce can be a long process, and any feelings of rancor may naturally be magnified. The feelings of any children involved should also be considered.

While movies and television shows often portray the dissolution of a marriage as something to be contested in court, it doesn’t always have to be adversarial.
